Disputes involving wills, estates, and succession matters can vary widely. This course introduces students to the legal framework that underpins Estate Litigation in British Columbia. Students will develop a broad understanding of the key issues in estate disputes, assess case studies and case law and acquire practical skills to effectively and competently navigate Estate Litigation files. Topics include wills variation claims, resulting trusts, unjust enrichment, curating defective wills, committeeship applications, issues with respect to spousal status and other novel estate litigation challenges that arise in BC.
Prerequisites
LAW 101, LAW 110 and LAW 210; OR 45 credits of 100-level or higher coursework
